MAXTOCODE (C) Software End User License Agreement

Important Notes?This Software End User License Agreement ("EULA") is a legal agreement between you (individual or entity -obtained by the entity, or purchased for the entity, or other methods) and MAXTOCODE. Please read the agreement carefully before installing and using the software. It provides with the license for using this software, including guarantee information and statement of obligation exemption. Installing and using this software shows that you have confirmed to accept this software, and agree to accept the restrictions prescribed in the terms of this agreement. If you do not agree to the terms of the agreement, please do not use the software. Since the pilot edition was provided, if you have paid and purchased, we will consider that you have agreed to this user license agreement. Whether other software is mentioned or introduced here or not, this EULA is only applicable for the software provided by MAXTOCODE here.

1. Definitions

(a) "Pilot Edition" means an identification edition of this Software which is free, and enables you to test and protect the feasibility of the protection program.

(b) " Standard Edition" means an identity edition of this Software, provided only for individual users not free of charge. About user distinguishment, please visit www.maxtocode.com.

(c) " Professional Edition" means an identity edition of this software, which only provides enterprise users and individual users at charge. About user distinguishment please visit www.maxtocode.com.

(d) "Software" only means the Aiasted.SOFT software program and the third party software procedure provided by Aiasted.SOFT under all circumstances, as well as corresponding documentations, related media, printed materials and online documentations or electronic documentations.

(e) Aiasted.SOFT means the developer who develops MAXTOCODE.

2. License grant

The license granted in the second part shall be in accordance with the terms and conditions prescribed in the EULA:
(a) According to the second part (b), you may install and use this Software on one computer; or install and store the software on a storage device (such as a network server) which is only used to install the software to other computers through the internal network, the precondition is that all computers needing to install and operate the software must have the license. Unless otherwise provided in the second part (b), this software license shall not be shared, installed or used on different computers.

(b) The portable or home computer needs to be activated by the mandatory product when using this software. For the software which needs the mandatory product to activate, except the software copy permitted within the second part (a), the primary user of the computer who has installed the software may develop the second copy, and install it on the portable or special-purpose home computer. The premise is: (A)the second copy of the software installed on the portable computer or the home computer (i) shall not be used simultaneously with the software copy which is on the mainframe;(ii) only primary user can use it through the form this edition permits (such as, only for teaching); (B) when such user is no longer the primary user of the mainframe where this software has been installed, he /she shall not install or use the second copy of this software; (C) there is no quantity discount when the software license is provided.

(c) You may develop a copy of machine-readable form only for the purpose of backup. You must duplicate all copyrights mark or other specialized signs of the software originals to all copies of this kind. You may not sell or transfer any copies of the software, which are developed for the he purpose of backup.

(d) You agree that Aiasted.SOFT may check how you use the software, in the form of reasonable notice at any time, so as to make sure whether you have complied with these terms or not. If you are found in this investigation that you have not completely observed the terms of this agreement when using the software, besides all the responsibilities caused by violating the agreement, you should also compensate Aiasted.SOFT for all reasonable charges related to the investigation,.

(f) You may not revise any parts of MaxtoCode, unless it is indicated in the source codes and/or in the documentations related to the software, or in the other separate agreements signed between you and Aiasted.SOFT.

(g) The copyright scope of MaxtoCode product includes MaxtoCode.exe, Attick.dll, as well as related procedures and explanatory documentations, etc. But it excludes ILdasm.exe or Ilasm.exe within the installation procedures of MaxtoCode. Their copyrights are reserved by Microsoft Corporation.

3. License restriction

(a) Except for provision prescribed in Part Two, you shall not fabricate or distribute copies of the software, or shall not transfer the software from one computer to another computer by form of e-mail, or transmitted by network

(b) You may not break the software into understandable form for human-being by modifying, consolidating, revising or translating the Software, or you may not reverse translation and edition, reverse engineering, de-compilation or through other forms.
(c) Unless otherwise stipulated herein you shall not lend, lease or resale this permission of the software to others.

(d) Except for pilot edition or non-resale edition, you shall abidingly be allowed to transfer the ownership endowed with you by EULA as a part of distribution or transfer under the preconditions that you shall not keep copy, you have transferred all software (including all groupware, medium and printed materials, all escalation program, this EULA, serial number and other software products attached to the software in any) and acceptor must agree with the terms of the EULA. In case that software is only an escalating program, any transfer shall contain previous editions before the escalation of the software. In case that the copy of this Software is a part of the integral Studio for transfer (refer to abovementioned for definition), you can only sale or transfer it as part of the integral Studio when transferring the software, no exclusive transfer is allowed. You shall not keep any copy of the Software and shall not sale or transfer any software purchased when enjoying quantity discount and you may not sale or transfer any probation editions of this Software or non- resale edition.

(e) Unless otherwise stipulated in the document, you shall not revise this software, or generate any product derived from it on the basis of this Software.

(f) Educational edition shall not be used or distributed to any party for commercial purpose.

(g) Unless otherwise stipulated in this document, you shall not (A) install or apply more than one pilot edition software; (B) download the pilot edition of this Software in more than one users name ; (C) revise the content in hardware or in computer system so as to enable the accumulated using time of the trial edition to exceed permissible period for probation edition; (D) disclose software performance indexes gained for pilot edition to any third party without the prior permission of Macromedia in written ; or (E) the purpose of applying this software pilot edition is not only for determination of buying commercial edition or education edition of this software; besides the aforesaid items, another precondition is to forbid you to install or use the probation software for any commercial training purpose.

(h) You are only allowed to use the non-resale software edition for inspection or software evaluation.

(i) You shall not use this software to develop any program with main function identical with the software.
(j) In case of your violation of the EULA, Aiasted.SOFT may terminate the permission, and you are required to destroy all copies of the software (after such termination, all other rights and any other rights offered in this EULA for both parties shall be remained.

4. Escalation program

If this software copy is an escalation to the previous edition, the precondition for providing escalation program is to permit for exchange. Your installation and action for applying this software copy shows that you are willing to terminate the previous EULA, furthermore you will not continue using the previous edition of the software or transfer it to other persons or economic entities, unless otherwise this transfer conforms to the provision specified in Part Three.

This EULA shall be equally used for previous edition permission
6. Responsibility limits

(a) In case of any loss arising out of unexpected problem in software application and due to the reason of using MAXTOCODE by affirmation Aiasted.SOFT will return full amount occurred in purchasing the software and terminate the business relation with customer. At same time you shall not use the MAXTOCODE any longer unless you buy it again.
